In short. We collect what you choose to give us, mainly an email address if you join the mailing list, along with standard technical information that any website receives. We use it to send you news about MAX and to run and improve the site. We do not sell your personal information.
Who we are and what this covers
This is the official site of the recording artist MAX. It is operated by Colour Vision Records (“we”, “us”), who are responsible for personal information collected through it. You can reach us at Miles@NoahGopen.com.
This policy applies to this website and to any pages, forms, sign-ups, competitions, stores or other online services we operate and link this policy from. It does not apply to services run by other companies, which are covered by their own policies.
Information we collect
Information you give us. Depending on what you choose to do, this may include your name, email address, phone number, postal code, country, date of birth, and anything you write to us or submit through a form, competition, presale or survey. If we ever sell goods or tickets directly, it may also include delivery and order details. Payment card details are handled by the payment provider, not by us.
Information collected automatically. When you visit, our hosting and security providers receive standard technical information such as your IP address, device and browser type, referring page, the pages you view and the time of your request. We may also use cookies or similar technologies, and analytics or performance tools, to keep the site working, keep it secure and understand how it is used.
Information from other sources. We may receive information about you from service providers and partners, for example an email or SMS platform, a ticketing company or promoter, a store or merchandise partner, a distributor or label partner, or a social media platform if you interact with us there or follow a link from one of their services.
Cookies and similar technologies
Cookies are small files stored by your browser. We may use ones that are necessary for the site to function and, where permitted, ones that measure traffic and performance or support marketing. Where the law requires your consent for non-essential cookies, we will ask for it before they are set, and you can change your mind at any time. You can also block or delete cookies in your browser settings, though parts of the site may then not work as intended.
How we use information
- To send you news about MAX, including releases, videos, tour dates, presales and merchandise, where you have asked to hear from us.
- To operate, secure, maintain and improve the site and our services.
- To respond to your messages and requests.
- To run competitions, presales, promotions and surveys.
- To understand how our audience uses the site so we can make it better.
- To fulfil orders and provide customer support, if you buy something from us directly.
- To comply with the law, enforce our terms, and prevent fraud, abuse or security incidents.
If you are in the UK or the EU, our legal bases are your consent for marketing and non-essential cookies, which you can withdraw at any time; performance of a contract where you have ordered something from us; our legitimate interests in running, securing and improving the site and promoting MAX; and compliance with legal obligations.
Who we share information with
We do not sell your personal information, and we do not share it for anyone else’s independent marketing. We do share it with:
- Service providers acting on our instructions, such as hosting, email and SMS platforms, analytics, e-commerce, ticketing and customer support providers.
- Label, distribution, management and promotional partners where they are involved in a release, campaign or event you have signed up for.
- Professional advisers such as lawyers and accountants.
- Anyone we are legally required to share with, or where we need to establish, exercise or defend legal claims.
- A buyer or successor, if the business or its assets are sold, merged or reorganised.
International transfers
We are based in the United States and our service providers may be located in the United States or elsewhere. If you are in the UK, the EU or another region with data transfer rules, your information may be transferred to countries whose laws differ from your own. Where required, we rely on appropriate safeguards such as standard contractual clauses.
How long we keep it
We keep personal information for as long as we need it for the purposes above, or for as long as the law requires. Mailing list details are kept until you unsubscribe or ask us to remove them, and every marketing message includes an unsubscribe link.
Security
We take reasonable measures to protect personal information, and we ask our providers to do the same. No website or transmission over the internet can be guaranteed completely secure, so we cannot promise absolute security.
Your rights
Wherever you live, you can ask us for a copy of what we hold about you, ask us to correct or delete it, or tell us to stop contacting you. Email Miles@NoahGopen.com and we will action it. We may need to verify your identity first.
If you are in the UK or the EU, you also have the rights of access, rectification, erasure, restriction of processing, data portability and objection, the right to withdraw consent at any time, and the right to complain to your national data protection authority.
If you are in California, you have the right to know what we collect and how we use it, to delete it, to correct it, and to opt out of the sale or sharing of personal information and of targeted advertising. We do not sell or share personal information as those terms are defined under California law. We will not discriminate against you for exercising any of these rights. Other US states give similar rights, and we will honour them where they apply.
Some browsers send a Do Not Track or Global Privacy Control signal. Where the law requires us to treat such a signal as an opt out, we do.
Children
This site is not directed at children under 13 and we do not knowingly collect their personal information. If you believe a child has given us information, contact us and we will delete it.
Links to other sites
This site links out to third party services, including streaming platforms, social media, the official store and ticketing partners. Once you follow one of those links you are on their site, under their privacy policy, not ours.
Changes
We may update this policy as the site, our services or the law change. The current version will always be posted on this page with a new date at the top, and where the law requires it we will ask for your consent before making a change that needs it.
